Dietmar Poszwa, Managing Director, Universum - Gennady Golovkin is allowing the news be spread on various boxing websites that he has achieved his objective in getting away from Universum and being a free agent from November 2011. In this respect, the following needs to be clarified:

Mr Golovkin completely failed with his lawsuit before Hamburg District Court to have the exclusive contract with Universum effectively terminated in January 2010. The court determined the unrestricted effectiveness of this contract concluded in November 2005 for the period of a total of six years. Mr Golovkin has now also failed with an application before the Appellate Court to have the enforcement of this judgement of the Court of First Instance temporarily discontinued. He based this application on the supposed defectiveness of the judgement of the Court of First Instance and apparent ineffectiveness of the contract. The Appellate Court also did not follow his views and instead of this suggested that he withdraws this application irrevocably with the consequence that Mr Golovkin is furthermore forbidden, on the basis of the exclusive contract until the contractually agreed end of the contract in November 2011, to take part in boxing matches in violation of Universum’s exclusive rights. Universum has waived a right to even extend the contract beyond the contractual expiry for periods lost by the boxer’s illness, since there were no such periods.

If it was to have been the intention of Mr Golovkin and his advisors, in spite of his termination of the contract already made in January 2010, to be exclusively bound to Universum until the end of the contract in November 2011and with this to risk considerable damage claims from Universum for his refusal to fulfil his contractual obligations, lasting in the meantime almost two years, one can congratulate him. The statement by his advisor and the proceeding, which will be continued before the Appellate Court in 2012, show where bad advice given to a boxer can lead.“
